These visas allow those whose only near relatives are living in Australia, to live in Australia as a permanent resident. There are two options – one is an onshore visa (835), and this is only for people are in Australia at the time they apply. The other option is an offshore visa (115), and this is only for people who are outside of Australia at the time they apply.
Who is eligible for a Remaining Relative visa (subclass 115)?
An applicant may be eligible if:- They are in Australia (if they are applying for the subclass 835) or outside of Australia (if they are applying for the subclass 115)
- The applicant (and their partner's) only near relatives are settled in Australia and are Australian citizens, permanent residents, or eligible New Zealand citizens
- One of your near relatives of their partner is prepared to be your sponsor
Other requirements for a Remaining Relative visa (subclass 115)
The applicant will need someone who can provide an assurance of support, and also meet health and character requirements. The sponsor must also meet certain citizenship, health and character requirements.
The sponsor must be the applicant's parent, brother, sister, stepbrother, stepsister, or one of their partners. They must agree to give support, accommodation and financial assistance for the first two years the applicant lives in Australia.
Benefits of the Remaining Relative visa (subclass 115)
This is a permanent visa that allows the applicant and their family to:
- Stay in Australia indefinitely
- Apply for Australian citizenship when eligible
- Travel to and from Australia
An applicant can also include their partner, any dependent children, and other dependent relatives on the application so long as they meet the requirements for being a member of the family unit.
